Article 13 – A Solution

Here’s is a proposed solution to Article 13 that could work for all of us. Please pass it along to anyone you think may help spread the idea. Some thought may be needed to the actual agreement, but I would leave that to Sir Tim Berners Lee (the inventor of the World Wide Web). Giving him a say would be a nice way to pay him back for the web :)

THE SOLUTION

Article 13 as I understand it places the responsibility of every piece of content being uploaded on the platform. So, that would make YouTube responsible for the content of the hundreds or thousands of videos that are being uploaded to the platform every second.

Obviously, this can’t work for YouTube or any other platform. There’s no way to police that amount of content.

So, the gist is that these platforms will do the only thing they can logically do, and that is to block content – to be on the safe side. Otherwise, they’d be getting in trouble every minute for somebody else’s content.

So, here’s what I’m thinking: if YouTube (and other affected platforms) put together an agreement for content creators that basically says “I am responsible for my own content and I absolve YouTube of that responsibility…” then that would cover YouTube’s back.

I’m not a lawyer, but you can see what I’m getting at here. If content creators take responsibility for their own content (and why wouldn’t they?) then that should in effect bypass the responsibility landing on the platform.

For this to work, the agreement would have to be only about article 13. There’s a potential here for platforms to take advantage of creators by creating an agreement that goes beyond Article 13, and that would not be cool. The agreement needs to be only about Article 13.

As I said, I’m not a lawyer and this is a big task so I would propose that Sir Tim Berners Lee (the inventor of the World Wide Web, without whom we wouldn’t be talking about Article 13 in the first place) lead the task of assembling the right people to oversee and finally approve any such agreement from any platform.

it would be a nice way for us all to pay Tim back – putting him in charge of saving the very thing he created for us all.
